These Forensics tests are not the opinions of a bloke down the pub with a dog who thinks “It’s a shooter” These reports come from the investment of the Crown prosecution service (CPS) itself and have been examined by the top most accreted individuals and organisations in their field. These reports and tests were used in real cases and have been proven that all 3 unanimously agree and concur that these items are not readily convertible and conform to the 1982 Firearms act. To somehow circumvent these established findings would amount to an abuse of process and can only think this would not be looked at in a favourable light by either the CPS or the courts.

The Act says :
Control of imitation firearms readily convertible into firearms to which section 1 of the 1968 Act applies.
1.)This Act applies to an imitation firearm if—
a) It has the appearance of being a firearm to which section 1 of the 1968 Act (firearms requiring a firearm certificate) applies;
and
b) It is so constructed or adapted as to be readily convertible into a firearm to which that section applies.
SUB-SECTION 5 STATUTARY DEFENCE
In any proceedings brought by virtue of this section for an offence under the 1968 Act involving an imitation firearm to which this Act applies, it shall be a defence for the accused to show that he/she did not know and had no reason to suspect that the imitation firearm was so constructed or adapted as to be readily convertible into a firearm to which section 1 of that Act applies.
In layman’s terms if you have purchased one of our Stens from this website and have read the above statement. No court in the land would uphold being in possession of an imitation firearm that is allegedly readily convertible and convict you. Besides we as a small company have no desire to put sub-standard products onto the market place which would contravene the laws of the land. We care too much for this industry to allow such things to happen.
The term readily convertible is further defined within the Act at Section 6
(6)For the purposes of this section an imitation firearm shall be regarded as readily convertible into a firearm to which section 1 of the 1968 Act applies if—
(a)it can be so converted without any special skill on the part of the person converting it in the construction or adaptation of firearms of any description; and
(b)the work involved in converting it does not require equipment or tools other than such as are in common use by persons carrying out works of construction and maintenance in their own homes.
If the item could not be made to discharge employing only house hold tools and no specialist knowledge then the threshold cannot be met as clearly anything could be made capable of discharge with the application of industrial tools or the substitution restricted components and specialist knowledge but that was not the express intention of Parliaments cited in the Act. The will of Parliament is further clarified further in Section 1 (4)
Section 1 (4) Citation, interpretation, commencement and extent.
b. The definition of firearm in section 57(1) of that Act shall have effect without paragraphs (b) and (c) of that subsection (component parts and accessories)
Having established that the item is a Realistic Imitation Firearm and not a deactivated firearm (defective or otherwise) is so constructed as to not be readily convertible under the provisions of the Firearms Act 1982.
Its sale must be lawful if it is in compliance with the provisions of the VCRA ACT 2006/ Regs 2007
Section 37
37 Specific defences applying to the offence under s. 36
(1) It shall be a defence for a person charged with an offence under section 36 in respect of any conduct to show that the conduct was for the purpose only of making the imitation firearm in question available for one or more of the purposes specified in subsection (2).
(2)Those purposes are—
(a)the purposes of a museum or gallery;
(b)the purposes of theatrical performances and of rehearsals for such performances;
(c)the production of films (within the meaning of Part 1 of the Copyright, Designs and Patents Act 1988 (c. 48)_see section 5B of that Act);
(d)the production of television programmes (within the meaning of the Communications Act 2003 (c. 21)_see section 405(1) of that Act);
(e)the organisation and holding of historical re-enactments organised and held by persons specified or described for the purposes of this section by regulations made by the Secretary of State;
(f)the purposes of functions that a person has in his capacity as a person in the service of Her Majesty.
The Violent Crime Reduction Act 2006 (Realistic Imitation Firearms) Regulations 2007 provide two further defences. The first is for the organisation and holding of air soft skirmishing. This is defined by reference to ‘permitted activities’ and the defence applies only where third party liability insurance is held in respect of the activities. The second defence is for the purpose of display at arms fairs, defined in the regulations by reference to ‘permitted events’.
Section 36 The VCRA 2006 regulates the import manufacture and trade in realistic imitation firearms there is no offence relating to the personal acquisition of a realistic imitation firearms nor its possession.

This is defined by reference to ‘permitted activities’ and the defence applies only where third party liability insurance is held in respect of the activities. The Regulations also specify the persons who can claim the defence for historical re-enactment. This is restricted to those organising or taking part in re-enactment activities for which third party liability insurance is held.
For manufacturers, importers and vendors to claim one of the defences, they must be able to show that their conduct was for a purpose of making realistic imitation firearms available for one of the reasons specified.
Can the vendor demonstrate that the purchaser had the requisite third party insurance required under the regulations in place at the time of purchase if YES then the vendor's transaction is lawful and in full compliance with the act and best practice.
He has sold a realistic imitation firearm for the purpose of making it available for a permitted purpose to a purchaser who is insured to engage in such activities.
Due to the Flat earther's of this world and the gravitational influence of the moon on the human body a recent case has gone through the courts that means we now have to vent our muzzles at an angle so that it does not fire in line to the cartridge The reasoning “they” give to this is that certain 8mm and 9mm Pac blank ammunition in Europe has a pepper /CS element that can be freely purchased in EUROPE. The fact that this, technically puts all section 2 ( Shotguns) into a section 5 category seems to have been lost in translation.
As most of you in this country will know this nature of ammunition is a section 5 authority only article. Therefore is controlled and as such would be an offence in acquiring it in its self.

Firearms Act 1968 Section 57
57 Interpretation.
(1)In this Act, the expression “firearm” means a lethal barrelled weapon of any description from which any shot, bullet or other missile can be discharged and includes—
(a)any prohibited weapon, whether it is such a lethal weapon as aforesaid or not; and
(b)any component part of such a lethal or prohibited weapon; and
(c)any accessory to any such weapon designed or adapted to diminish the noise or flash caused by firing the weapon;
and so much of section 1 of this Act as excludes any description of firearm from the category of firearms to which that section applies shall be construed as also excluding component parts of, and accessories to, firearms of that description.

If these Realistic Imitation Firearms were to be altered or changed in any way from its original construction and specification and presented to me, the authorities would have my full support in helping to bring the full force of the law into play. The abuse of our products would not be tolerated as it brings our hobbies and legitimate activities into question once again and it is hard enough to keep up with the ever impending legislation hanging over our heads like Damocles sword .
